GENERAL REGULATIONS ON DATA PROTECTION (GDPR): WHAT’S NEW FOR THE GENERATION OF LEADS?
The upcoming General Data Protection Regulation (GDPR) is going to affect how you generate leads and how you manage them. Indeed, if this new standard is only the logical extension of the reasoning initiated, for a few years, at the national and European level in terms of personal data; it devotes, all the same, some novelties. However, the regulations specify that this right is not without limit and must meet specific conditions (irrelevant data, obsolete data, etc.). Finally, the regulation provides for the possibility of collective complaints to the supervisory authorities in the event of a dispute. These are only examples, the General Data Protection Regulation contains many other provisions. But, as stated previously, nothing is really surprising.
The text only improves most of the existing rights. A reinforced data security obligation The main objective of the regulation is to maintain effective data protection. Until now, when a security breach was found, the person in charge had to inform the Cnil without delay. This obligation to notify security breaches is provided for in article 34 bis of the Data Protection Act. However, it only concerned a limited number of players (internet service providers and telecom operators). The European regulation now extends this obligation to all data controllers without exception.
GDPR: 2 major reinforcements impacting lead generation
While the text as a whole only seems to improve existing mechanisms, there are two major upheavals. Indeed, the regulation intends to apply these provisions to all actors processing personal data, whether they are European or not, whether they are on European soil or not. In addition, the new text provides for the outright abandonment of prior declaration formalities with the national authorities, in favor of a principle of “responsibility”. These two reinforcements will be the subject of more detailed developments. In conclusion, the very form of this new standard is as important as its content. Indeed, until then, many directives governed European law on personal data.
The directives set a common goal to be achieved by member states. They can use whatever means they choose to achieve this. Consequently, the finding today is as follows: European legislation on the protection of personal data is totally disparate. Conversely, a regulation is a standard which is directly integrated into the internal order of states (therefore without a transposition law). The general data protection regulation should unify the laws of the member states on the subject as effectively as possible.
